1. IDENTIFICATION OF THE PROPERTY OWNER

These Terms and Conditions of Sale (hereinafter the “Terms”) govern the booking and stay conditions for the vacation rental accommodation known as Maison Poumo, operated by Magnanou Bocquet SAS (hereinafter the “Owner” or “Lessor”), offered as a short-term furnished rental directly via its website.

The property is located at:
4500 route de Robion – 84800 L’Isle-sur-la-Sorgue – France

These Terms apply to all direct bookings made with the Owner, including via its website, by any customer acting in a private or professional capacity (families, groups, corporate clients, tourists) for a temporary stay that does not constitute a primary residence and does not grant any right of tenancy or long-term occupancy.

2. PURPOSE – PROPERTY DESCRIPTION

2.1 Purpose of the Agreement

These Terms define the rights and obligations of the parties in connection with the short-term rental of the furnished tourist accommodation “Maison Poumo”.

The rental is strictly temporary and granted solely for vacation or short-term professional accommodation purposes, excluding any use as a primary residence, secondary residence, or mixed-use dwelling, as well as any commercial, event-related, or professional activity not expressly authorized in writing by the Owner.

2.2 Property Description

The accommodation includes in particular:

A. Interior spaces

Approximately 110 m² comprising:

• 2 double bedrooms
• 1 triple bedroom
• 1 dormitory area with 2 bunk beds and 1 trundle bed
• 1 living area with fully equipped kitchen, dining area, and lounge
• 1 bathroom with shower, bathtub, and toilet
• 1 additional shower room
• 1 laundry room with washer and dryer
• 1 separate toilet

B. Outdoor areas and amenities

• a raised terrace adjoining the living area
• approximately 1 hectare of private garden
• an outdoor unheated swimming pool secured by a fence and gate compliant with applicable regulations
• access to a covered padel court located in a shared barn with the owners, reserved exclusively for guests during their stay

Certain areas of the barn remain strictly private and are not accessible to guests.

2.3 Occupancy Capacity

The property is rented for a specific number of occupants stated at the time of booking.

Any additional occupancy must be subject to prior written approval from the Owner.

In case of unauthorized excess occupancy, the Owner may:

• request immediate compliance, or
• terminate the stay in case of material breach of contract conditions.

2.4 No Subletting or Assignment

This rental agreement is entered into on a personal basis (intuitu personae) in favor of the booking client.

It may not be transferred, assigned, or made available to any third party, whether free of charge or for consideration, without the Owner’s prior written consent.

Any breach shall constitute a material violation of the contract and may result in immediate termination of the stay at the sole fault of the Client, without refund.

3. STAY DURATION

The rental is granted for the fixed period agreed upon at booking.

Unless otherwise stated:

• Check-in: from 4:00 PM
• Check-out: by 10:00 AM

The rental automatically ends at the agreed date and time without renewal.

Unauthorized late departure may result in additional charges and/or compensation for disruption of operations.

4. BOOKING – CONTRACT FORMATION

A booking becomes binding once all of the following conditions are met:

• acceptance of the booking by the Owner
• unconditional acceptance of these Terms
• payment of the required deposit
• submission of required contractual documents upon request

The Owner reserves the right to refuse any incomplete, irregular, fraudulent, or unsuitable booking.

5. PRICE – PAYMENT TERMS

5.1 Total Price

The total price is communicated before booking confirmation and includes:

• rental fee
• mandatory cleaning fee (€200)
• tourist tax (as legally applicable)
• any optional services expressly selected

The security deposit is not included in the price.

5.2 Deposit

A 30% deposit is required at booking.
The reservation is confirmed only upon receipt of payment.

5.3 Balance Payment

The remaining balance is due no later than 15 days before arrival.

Failure to pay on time may result in suspension or cancellation of the booking.

5.4 Payment Methods

Accepted payment methods include:

• bank transfer
• credit/debit card via the Owner’s payment platform

Bank fees, exchange fees, or transaction charges are borne by the Client.

6. REQUIRED DOCUMENTS

The Client agrees to provide, upon request:

• valid ID of the booking holder
• booking confirmation
• proof of vacation rental liability insurance (or equivalent coverage)
• any other document necessary for contract execution

Failure to provide such documents may result in denial of access without refund.

7. TAX, CLEANING & INCLUDED SERVICES

7.1 Cleaning Fee

The mandatory cleaning fee covers post-stay cleaning and linen services.

However, the Client must return the property in reasonable condition. Excessive dirt, waste, or abnormal cleaning needs may result in additional charges.

7.2 Tourist Tax

Tourist tax is charged in accordance with applicable local regulations and may vary.

8. CANCELLATION POLICY

8.1 Cancellation by the Client

• more than 45 days: 100% refund (minus payment processing fees where applicable)
• 45 to 30 days: 50% refund
• less than 30 days: no refund

8.2 Early Departure

No refund for shortened stays.

8.3 No-show

No refund.

8.4 Changes

Any modification is subject to Owner approval and possible price adjustment.

8.5 Cancellation by the Owner

Full refund of amounts paid, without additional compensation except where required by law.

9. SECURITY DEPOSIT

A €1,500 security deposit is required to cover:

• damage to property or equipment
• loss or theft
• excessive cleaning
• unpaid charges
• any contractual breach

The deposit is typically held via pre-authorization.

Refund within 7 days after departure, subject to inspection.

10. HOUSE RULES – OCCUPANCY

The Client agrees to:

• use the property peacefully and responsibly
• respect neighbors and surroundings
• avoid any disturbance

Parties, events, loud gatherings, or unauthorized receptions are strictly prohibited.

Smoking is prohibited indoors.

Pets are not allowed unless expressly authorized.

11. POOL – PADEL COURT – OUTDOOR EQUIPMENT

Use of all amenities is at the guests’ own risk.

The Client is fully responsible for all occupants.

Children must be supervised at all times, especially around the pool.

The Owner accepts no liability for accidents resulting from misuse or lack of supervision.

12. ELECTRIC VEHICLE CHARGING STATION

Where available:

• reserved for compatible electric vehicles
• usage must follow safety instructions
• billed at €0.16/kWh unless otherwise stated
• may be suspended for safety or technical reasons

13. INSURANCE

The Client must maintain valid liability insurance covering:

• rental risks
• property damage
• third-party liability

Proof may be requested before arrival.

14. CHECK-IN / CHECK-OUT – CLAIMS

If no check-in inventory is completed, the property is presumed to be in good condition.

Any issue must be reported within 24 hours of arrival.

After departure, damages may be charged based on evidence (photos, reports, invoices).

15. LIABILITY OF THE CLIENT

The Client is fully responsible for:

• all occupants
• all damages or losses
• compliance with these Terms

16. LIABILITY OF THE OWNER

The Owner is not liable for:

• theft or loss of personal belongings
• service interruptions beyond control
• improper use of facilities
• force majeure events

Liability is limited to direct and foreseeable damages where legally applicable.

17. BREACH – EARLY TERMINATION

In case of serious breach, the Owner may:

• retain all or part of the deposit
• charge repair costs
• terminate the stay immediately without refund

Serious breaches include:

• unauthorized subletting
• disturbance or unsafe behavior
• exceeding occupancy limits
• damage to property

18. FORCE MAJEURE

Neither party shall be liable for failure due to force majeure as defined under Article 1218 of the French Civil Code.

19. PERSONAL DATA

Data is processed for:

• booking management
• contract execution
• legal obligations
• security purposes

Clients have rights of access, correction, deletion, and objection under GDPR.

20. VIDEO SURVEILLANCE

CCTV is installed in:

• parking area
• barn access doors
• barn exterior areas

No cameras are installed inside the house, pool area, or private spaces.

Footage is retained for up to 15 days unless required for legal proceedings.

21. GOVERNING LAW – DISPUTES

These Terms are governed by French law.

22. ACCEPTANCE

By booking, the Client fully accepts these Terms without reservation.
